3. Will Your Information Be Shared With Anyone?
In short: We only share information with your consent, to comply with laws, to provide you with services, to protect your rights, or to fulfill business obligations.
We may process or share your data based on:
Consent — where you've given specific permission.
Legitimate Interests — where reasonably necessary for our legitimate business interests.
Performance of a Contract — to fulfill our obligations to you, including generating reports from your connected TikTok Shop data.
Legal Obligations — where required by applicable law, court order, or governmental request.
Vital Interests — to investigate or prevent fraud, policy violations, or safety threats.
We may also share information during Business Transfers — mergers, asset sales, financing, or acquisitions.
We do not sell your personal information or your TikTok Shop store data to third parties for their own marketing purposes.
4. Do We Use Cookies and Other Tracking Technologies?
In short: We keep your information only as long as necessary for the purposes in this notice, unless a longer period is required by law.
We retain personal information no longer than one (1) month past the termination of your account, except where a longer retention period is required by law (e.g., tax or accounting obligations). When there is no ongoing legitimate need to process your data, we delete or anonymize it, or securely isolate it until deletion is possible.
6. How Do We Keep Your Information Safe?
In short: We use organizational and technical security measures to protect your information, though no method of transmission or storage is 100% secure.
We have implemented reasonable technical and organizational security measures. However, no transmission over the internet can be guaranteed completely secure, and we cannot promise that unauthorized parties will never gain access to your data.
We are an ISO-certified company. All merchant data is securely stored on AWS servers located in Oregon, USA, and we follow TikTok Shop's platform guidelines and developer requirements for compliance and best practices when handling data accessed through your connected TikTok Shop account.
7. Do We Collect Information From Minors?
In short: We do not knowingly collect data from or market to children under 18.
By using the Website or Services, you represent that you are at least 18, or are the parent/guardian of a minor consenting to their use. If we learn that data has been collected from someone under 18, we will deactivate the account and delete such data. Contact support@reportpundit.com if you become aware of any such data.
8. What Are Your Privacy Rights?
In short: Depending on your region, you may have rights to access, correct, restrict, or delete your personal information.
Residents of the EEA, UK, and other regions with applicable data protection laws may have rights including access, rectification, erasure, restriction of processing, and data portability. To exercise these rights, contact support@reportpundit.com.
If we rely on your consent to process data, you may withdraw it at any time, without affecting prior lawful processing.
Account Information. You may review, update, or terminate your account via your account settings or by contacting us. Some information may be retained to prevent fraud, resolve disputes, or comply with legal obligations.
Marketing opt-out. Unsubscribe via the link in our emails, or contact us directly.
9. Controls for Do-Not-Track Features
We do not currently respond to Do-Not-Track (DNT) browser signals, as no uniform standard currently exists. We will update this notice if that changes.
10. Google Limited Use Policy
Report Pundit's use and transfer of information received from Google APIs (where applicable to your account) adheres to the Google API Services User Data Policy, including its Limited Use requirements.
11. Do California Residents Have Specific Privacy Rights?
In short: Yes — California residents have specific rights regarding access to personal information.
Under California Civil Code Section 1798.83 ("Shine The Light"), California residents may request, once a year and free of charge, information about categories of personal data we've disclosed to third parties for direct marketing purposes.
California residents under 18 with a registered account may request removal of publicly posted data by contacting us with their account email and a statement of California residency. We will remove the data from public display, though it may remain in backups or other internal systems.
12. Do We Make Updates to This Notice?
In short: Yes, as necessary to remain compliant with applicable laws.
We may update this notice periodically. Material changes will be indicated by an updated "Last updated" date and, where appropriate, direct notification.

The software Report Pundit for TikTok Shop ("the Software") is the property of Dayspring Technologies Private Limited.
Dayspring Technologies Private Limited is a company incorporated under the Companies Act, 1956.
Your use of this Software is governed solely by this policy and any related agreement referenced in these Terms of Service. By using the Software, you agree that you are contracting with, and undertaking binding obligations to, Dayspring Technologies Private Limited.
For the purpose of these Terms of Service, "You" or "User" means any natural or legal person who has agreed to use the Software by providing registration data during sign-up, typically as a TikTok Shop seller or merchant. "We", "Us", or "Our" means Dayspring Technologies Private Limited.
You will be subject to any additional rules, guidelines, policies, terms, and conditions applicable to services provided through this Software, all of which are incorporated into, and form part of, these Terms of Service.
We reserve the sole right to modify these Terms of Service without prior notice. It is your responsibility to periodically review the terms. Continued use of the Software after any change constitutes your acceptance of the amended terms. Provided you comply with these Terms of Service, We grant you a personal, non-exclusive, non-transferable, limited privilege to access and use the Software.

2. Membership and Terms of Acceptance
Use of this Software is available only to those who are competent to contract under the laws applicable to their nationality, which excludes insolvents and minors. If you are a minor, you may use the Software only through a legal guardian; Dayspring Technologies Private Limited reserves the right to terminate your account upon learning that a minor is using it independently.
You are solely responsible for protecting the confidentiality of your username and password. Any activity under your account is deemed to have been carried out by you. If you provide false or inaccurate details, or We have reasonable grounds to believe you have done so, We reserve the right to permanently suspend your account.
Dayspring reserves the right to update these Terms of Service at any time without notice. The most current version can always be reviewed via the "Terms of Service" link on our website.
3. Communications
By using this Software, you consent to receiving emails from Us, including communications relevant to your use of Report Pundit with your TikTok Shop account. To opt out, email support@reportpundit.com. Your contact information is handled per our Privacy Policy and is not shared with third parties.
4. Charges
Membership is based on a subscription fee model. We reserve the right to amend our pricing or fee structure. Any such changes will be communicated to you in advance, and you may decide whether to continue using the Software under the revised terms.
5. User Obligations
You are a restricted user of this Software.
5.1 You may not distribute, modify, recreate, reverse engineer, create derivative works from, transfer, or sell any information obtained from the Software without our prior permission. Unlimited or wholesale reproduction or unwarranted modification of Software content is not permitted.
5.2 You agree not to access the Software or its Services by any means other than the interface We provide — no deep-linking, scraping, bots, or automated methods to acquire, copy, or monitor Software content. You acknowledge that by using the Software, you may encounter content from other users that you find objectionable; We disclaim liability for such content but welcome reports of it.
5.3 Users are permitted to install and use the Software on a month-to-month basis.
You may not use the Software to advertise, solicit, or send unsolicited commercial communications to other Users, or to harass, abuse, or harm any person. We reserve the right to suspend or terminate accounts found in violation of applicable law or the spirit of these Terms, though you remain solely responsible for your own use of the Software.
6. Software Availability
Any software made available through the Services is the copyrighted work of Dayspring and/or its suppliers, governed by any accompanying End User License Agreement ("License Agreement"). Third-party scripts or code referenced from our website are licensed by their respective owners, not by Dayspring Technologies Private Limited.
Reproduction or redistribution of the Software outside the License Agreement is prohibited and may result in civil and criminal penalties.
7. System Requirements
You should have access to a Windows or Mac computer with a supported browser (Chrome, Microsoft Edge, Firefox, or Safari — latest version).
8. Third-Party Software
We do not provide facilities to download or access any third-party software through our Software or website, other than integrations explicitly offered as part of the Report Pundit service (such as connections to TikTok Shop's platform).
9. Disclaimer of Warranties and Liabilities
To the maximum extent permitted by law, the Software, Services, and related materials are provided on an "as is" basis, without warranties of any kind, express or implied, including implied warranties of title, non-infringement, merchantability, or fitness for a particular purpose. We do not warrant that:
(i) your requirements will be met, or that the Services will be uninterrupted, timely, secure, or error-free;
(ii) materials, data, or results obtained through the Software will be accurate or reliable;
(iii) any errors or defects will necessarily be identified before you report them to support@reportpundit.com.
You acknowledge that any data downloaded or obtained through the Software is at your own discretion and risk, and you are solely responsible for any resulting damage or data loss.
10. Security
Where the Services require an account, you agree to provide current, complete, and accurate registration information, and to choose a password and username. You are solely responsible for maintaining confidentiality of your credentials and for all activity under your account. Notify Dayspring immediately of any unauthorized use or security breach. Dayspring is not liable for losses arising from unauthorized use of your account or password, though you may be held liable for losses incurred by Dayspring or third parties as a result. You may not use another person's account without their permission.
11. Indemnification and Limitation of Liability
You agree to indemnify, defend, and hold harmless this Software — including its affiliates, vendors, agents, and employees — from all losses, liabilities, claims, damages, and expenses (including legal fees) arising from your breach of these Terms, your misuse of the Software, or your violation of any third party's rights, including intellectual property rights.
In no event shall we, our officers, directors, employees, partners, or suppliers be liable for any special, incidental, indirect, consequential, or punitive damages — including loss of use, data, or profits — arising from your use of or access to the Software, Services, or materials, regardless of the theory of liability.
These limitations apply to the maximum extent permitted by applicable law.
12. Compliance with Law
You acknowledge that the Services, Software, and Materials may be subject to applicable export laws and regulations, and you agree to comply with them. You are responsible for complying with all laws applicable to you or your jurisdiction — including, where applicable to Indian users, the Foreign Exchange Management Act 1999, the Information Technology Act 2000 (as amended), the Prevention of Money Laundering Act 2002, the Foreign Contribution Regulation Act 1976, the Income Tax Act 1961, and India's Export Import Policy — in connection with your use of the Software and any associated payment facilities.
13. Disputes and Jurisdiction
All disputes will be resolved through a two-step Alternate Dispute Resolution process.
13.1 Stage 1: Mediation. Disputes will first be referred to a mutually agreed, neutral sole mediator. If the parties cannot agree on a mediator, the Company reserves the right to make the final selection. The mediator's decision is non-binding, though parties are expected to act in good faith toward it.
13.2 Stage 2: Arbitration. If mediation fails, the matter proceeds to binding arbitration before a three-member Arbitration Board (one member appointed by each party, and a third jointly nominated by those two). The arbitration award is final and binding, conducted in English, and situated in Karnataka.
This Agreement is governed by the laws of India, with courts in Bengaluru, India having exclusive jurisdiction over any related disputes.
14. Data Provided by Us
14.1 We take reasonable care to ensure the accuracy of data provided through our Software, including data drawn from your connected TikTok Shop account. System errors may occasionally occur, and we are not responsible for inaccuracies arising from third-party data sources.
14.2 We are not liable for losses arising from our negligence, breach of contract, IP or trademark infringement, or breach of applicable law, except as required by law.
15. Termination
You may terminate your use of the Software at any time. Termination may include: (a) removal of access to all Service offerings; (b) deletion of your account data, including personal information, login credentials, and related files; and (c) discontinuation of further use of the Services.
16. Disclaimer
We assume no liability for damage or injury arising from use of any product, information, or instruction provided through the Software. We reserve the right to change or discontinue any aspect of the Software at any time. We are not liable for misuse of the Software by any user.
